Terms of Service

Welcome to Tinkr! Please read these Terms of Service carefully before using our platform. By accessing or using Tinkr, you agree to be bound by these terms.
1. About Tinkr
Tinkr is a marketplace platform that connects people who need help with tasks ("Task Posters") to individuals seeking flexible income opportunities ("Task Takers"), primarily students and others in the community. We facilitate connections but do not employ Task Takers or directly provide services.
2. Acceptance of Terms
By creating an account, accessing, or using Tinkr's services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you don't agree to these terms, please don't use our platform.
3. User Eligibility
3.1 Age Requirements
- You must be at least 18 years old to create an account or use Tinkr
- Tinkr is not available to individuals under 18, regardless of parental consent or supervision
- We reserve the right to verify age and may suspend or terminate accounts that violate this age requirement
3.2 Account Requirements
- Provide accurate, current, and complete information during registration
- Maintain and update your account information
- Keep your login credentials secure and confidential
- Notify us immediately of any unauthorized use of your account
4. User Categories and Responsibilities
4.1 Task Posters
As a Task Poster, you agree to:
- Provide accurate and detailed task descriptions
- Set fair and reasonable compensation
- Treat Task Takers with respect and professionalism
- Ensure tasks comply with local laws and regulations
- Pay agreed compensation promptly upon task completion
- Provide a safe working environment for in-person tasks
4.2 Task Takers
As a Task Taker, you agree to:
- Accurately represent your skills and availability
- Complete tasks according to agreed specifications and timeline
- Communicate professionally and promptly
- Maintain confidentiality of Task Poster information
- Follow all safety guidelines and local regulations
- Be responsible for your own tax obligations and insurance
5. Fees and Payments
5.1 Service Fees
- Task Posters: a Connection & Support fee of 12% of the agreed task price, with a minimum of €2.50 per task, added on top of the task price. The task price, Connection & Support fee and total are shown before you confirm any payment. The Connection & Support fee is non-refundable: it is charged for matching you with a Task Taker, secure payment handling and support, and it is not returned if the task is later cancelled, disputed or refunded. You will be asked to acknowledge this before your first payment, and the fee is labelled non-refundable on every payment screen.
- Task Takers: a commission of 3% of the agreed task price, deducted from the task price before it reaches your payout account. The commission is fixed at the moment the Task Poster pays. Your current commission rate is shown before you apply for or accept a task, and at all times in Earnings.
- Minimum task price: €5.00.
- Payment processing costs are covered by Tinkr out of the fees above; no separate processing fee is charged, and paying by card costs the same as paying with iDEAL | Wero.
5.2 Founding Tasker Promotion
- Every account created before 1 June 2027 (00:00 Amsterdam time) is automatically enrolled as a Founding Tasker.
- Founding Taskers pay 0% commission on their first €500 of cumulative task earnings, or for 90 days from their signup date, whichever comes first.
- Once either limit is reached, the standard 3% commission applies automatically to all further earnings. If a single task crosses the €500 limit, commission is charged only on the part of the task price above it.
- The terms of the promotion that apply to you are fixed when you are enrolled and are shown in Earnings together with your remaining allowance and days. The part of the allowance a task uses is reserved when the Task Poster pays, and given back if that payment is refunded.
5.3 Payment Terms
- Payments are processed by Stripe. Task Posters pay with iDEAL | Wero or a card; the total is the same whichever method is used.
- Task Takers must set up a payout account before applying for tasks. Setup happens in the Tinkr app: you confirm who you are (name, date of birth and home address in the Netherlands, and an ID check with a photo of your passport, ID card or driving licence) and add the bank account your earnings are paid out to. These details are sent from your device to Stripe, which verifies them. Tinkr does not see or keep photos of your ID.
- Payment services are provided by Stripe and are subject to the Stripe Connected Account Agreement, which includes the Stripe Terms of Service (together, the "Stripe Services Agreement"). By agreeing to these terms or continuing to receive payments through Tinkr, you agree to be bound by the Stripe Services Agreement, as it may be modified by Stripe from time to time. As a condition of Tinkr enabling payment services through Stripe, you agree to provide Tinkr accurate and complete information about you, and you authorise Tinkr to share it and transaction information related to your use of the payment services provided by Stripe. Your payout account has no separate Stripe dashboard: you view your earnings and withdraw them in the Tinkr app.
- Tinkr is required by law (EU Directive 2021/514, "DAC7") to report the earnings of Task Takers to the Dutch Tax Administration (Belastingdienst) once a year. For this, Task Takers provide their citizen service number (BSN) during payout setup, and Tinkr keeps the details required for the report. You will receive a copy of what is reported about you. If you do not provide these details, Tinkr may have to pause your payouts or close your account, as the law requires.
- Stripe may ask for more information later (for example when your earnings pass a threshold). Tinkr will tell you in the app what is needed and by when; if it is not provided in time, payouts may be paused until it is. Your earnings stay in your payout account in the meantime.
- When a Task Poster accepts a Task Taker, the Task Poster pays the task price plus the Connection & Support fee. The task price minus the Task Taker's commission goes directly to the Task Taker's own payout account at Stripe, where it is held until the task is released. Tinkr only receives the Connection & Support fee and the commission; Tinkr does not hold Task Takers' earnings.
- Upon task completion and approval, the held earnings are released and the Task Taker can withdraw them to their own bank account, from a minimum of €20. Released earnings that have not been withdrawn are paid out to the Task Taker's bank account automatically after about 80 days, whatever the amount. Earnings can only be paid out to the Task Taker's own bank account and cannot be used to pay for tasks on Tinkr.
- After the Task Taker marks a task as complete, the Task Poster has 48 hours to confirm it or report a dispute. If neither happens within 48 hours, the payment is released to the Task Taker automatically.
- Either party can report a dispute using "Report an issue" on the task. Once a dispute is reported, the payment stays held and is not released automatically; it is released or refunded only after Tinkr's support team has reviewed the case.
- A payment that has already been released (after confirmation or after the 48-hour period) can no longer be disputed through the app; contact support if something went wrong.
- Please use "Report an issue" or contact support rather than disputing a Tinkr payment with your bank (a chargeback). If you file a chargeback, Tinkr will respond to it using the task's records (including your confirmations and these terms), payments on your account will be paused while our support team reviews it, and unjustified or repeated chargebacks may lead to suspension of your account and recovery of the amount. This does not limit your rights as a cardholder or account holder.
- Card payments are verified with your bank (3D Secure) when you pay.
- Refunds are decided on a case-by-case basis following a dispute review. A refund covers the task price only, which is taken back from the Task Taker's payout account and returned to the Task Poster's payment method; the Connection & Support fee is non-refundable. Nothing in these terms limits any refund rights you have under mandatory consumer law.
6. Prohibited Activities
The following activities are strictly prohibited:
- Tasks involving illegal activities or substances
- Adult services or sexually explicit content
- Dangerous activities that could result in injury
- Harassment, discrimination, or abusive behavior
- Circumventing Tinkr's fees or payment systems
- Creating fake accounts or providing false information
- Spamming or soliciting users for external services
- Tasks that violate intellectual property rights
7. Safety and Verification
7.1 User Verification
- Student verification is available with a valid student ID
- Government ID verification is planned but not yet available on the platform
- Verified users may receive priority placement and enhanced trust indicators once available
- We reserve the right to suspend unverified accounts for safety reasons
7.2 Safety Measures
- Report suspicious or inappropriate behavior immediately
- Meet in public places for initial consultations when possible
- Trust your instincts and prioritize personal safety
- Use our in-app messaging system for communications
8. Intellectual Property
Tinkr and its original content, features, and functionality are owned by Tinkr and are protected by international copyright, trademark, and other intellectual property laws. Users retain ownership of their content but grant Tinkr a license to use it for platform operations.
9. Privacy and Data Protection
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms of Service by reference.
10. Disclaimers and Limitations of Liability
10.1 Platform Disclaimer
Tinkr is a marketplace platform only. We do not:
- Employ Task Takers or control how they perform tasks
- Guarantee the quality, safety, or legality of tasks or services
- Conduct comprehensive background checks on all users
- Assume responsibility for interactions between users
10.2 Limitation of Liability
To the maximum extent permitted by law, Tinkr shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the platform. Our total liability shall not exceed the amount of fees paid by you in the 12 months preceding the claim.
11. Insurance and Independent Contractor Status
- Task Takers are independent contractors, not employees of Tinkr
- Users are responsible for their own insurance coverage
- Tinkr does not currently offer task insurance for purchase; this may be introduced in the future
- Report any incidents or injuries immediately
12. Dispute Resolution
12.1 Platform Mediation
- We provide dispute resolution services for payment and task-related issues
- Users must first attempt to resolve disputes directly
- Report payment disputes through the app within 48 hours of the Task Taker marking the task complete (see section 5.3)
12.2 Legal Disputes
Any legal disputes that are not resolved through the platform mediation process above will be subject to the courts as set out in Section 15 (Governing Law).
Data protection rights are not affected: Nothing in this section limits your rights under the GDPR, including your right to lodge a complaint with a supervisory authority (such as the Autoriteit Persoonsgegevens in the Netherlands) or to bring a claim before a competent court, including the courts of your own EU country of residence, in each case at any time.
13. Account Termination
13.1 Termination by User
- You may terminate your account at any time
- Outstanding payments and obligations remain due
- Your earnings are never forfeited when you delete your account: earnings for tasks that are not yet settled must be settled first, and released earnings are paid out to your bank account before the account is deleted
- Data retention follows our Privacy Policy
13.2 Termination by Tinkr
We reserve the right to suspend or terminate accounts for violations of these terms, illegal activity, or to protect the safety and integrity of our platform.
13.3 Reports and Moderation
You can report another user from the chat (for example for a scam, a request to pay outside Tinkr, harassment or a safety concern), report a task from the task page (for example when it is not allowed on Tinkr, misleading or a scam), and report a review (for example when it shares your personal details or is abusive). Our support team reviews every report, and may read the conversation the report is about. We let you know when we have reviewed your report, but we do not share what happened to the other person.
To keep payments in Tinkr, phone numbers, email addresses, links and bank details are hidden in chats (phone numbers can be shared on the day of the task, once someone has been accepted), and are removed from task descriptions and profiles. Repeated attempts to share them, several reports from different people, repeated no-shows or lost disputes, and a very low rating bring an account to the attention of our support team. A person always reviews the account before any measure is taken.
Depending on what happened and on earlier problems, we may take one of these measures:
- Warning: a message explaining which rule was broken
- Hiding a review: the text of a review that shares personal details is hidden (the star rating stays), and a review that is abusive or not about the task is removed and no longer counts towards the rating
- Removing a task: a task that breaks these terms is taken offline and open applications are declined (not possible once someone has been accepted; then the dispute process applies)
- Restriction: for a set number of days you cannot post tasks, apply or send messages
- Suspension: for a set number of days you cannot log in
- Closure: your account is closed permanently
We always tell you which measure we took, until when, and why. If you think a decision is wrong, contact Tinkr Support in the app or email help@tinkr.care and we will review it again. This does not affect your right to go to court.
14. Changes to Terms
We may update these Terms of Service from time to time. Users will be notified of significant changes through the platform or email. Continued use after changes constitutes acceptance of the new terms.
15. Governing Law
These Terms of Service are governed by the laws of the Netherlands. Any disputes will be subject to the exclusive jurisdiction of the courts in Amsterdam, Netherlands, except where mandatory consumer protection or data protection law gives you the right to bring a claim in the courts of your own country of residence, or to lodge a complaint with your local data protection supervisory authority — those rights remain available to you regardless of this clause.
